Whereas in and by a certain decretal order of his
majestys Court of Exchequer made the twenti¬
fourth day of February One thousanc seven
hundred and fifty seven in acertain Cause there
then depending Wherein Mary Le souzey James
LeCount and ann his wile Elizabeth Boudet
an Infant by Julian Boudel her next friend
Jane la Huijs Daughter of Jane le Count an Infant
by sames le Count her naal friend and others
residuary legaties named in the will of Gideon
Lauberaine were complainants and Nicholas
Clerembault and Peter Thomas Executors of Gidcon¬
Lauberain James Demidis and ann his wie one
other of the residuary legatees of the said Gideon
Lauberaine and others were Defendants the
defendant Peter Thomas the surviring Executor
of Gideon Lauberaine was directed to pay inte
the hands of Charles Taylor Esqr. deputy re
menbrancer of the said Court the sum of six hun
dred and thirty four pounds seventeen shillings
and Eleven pence therein mentioned and to deliver up to
him the Tewells Plate and Pictures and also trans
ferr and assign to the said Charles Taylor the long
annuily order and olher Governement securitys
therein particularly mentioned in order that the
same might besold by the said Charles Taylor who
was to pay and distribute the produce thereof with
the dividends which should be received thereon te
gether with the said sum of six hundred and
thirty four pounds seventien shillings and Eleven
pence and also the produce of the said Jewells
Plate and Pictures therein mentioned to and
amongst the several Plainliffs in the said Cause
and the said defendant James Demides and ann

Berens and John Berens of London merchants
Jointly and severally her truc and lawfull attorneys
or Attorney for her and in her name and to and for
her use and benefit to ask and receive of the said
Charles Taylor Esqr. deputy remembrancer of his
majestijs said Court of Exchequer the said sum of
One huindred and sixty nine pounds twelve shil
lings one penny farthing being the moiety of One
tenth of the said sum of three thousand three
hundred and ninely two pounds two shillings and
twe pence half penny the net produce of the per¬
sonal Estate of the said Gideon Lauberaine in and
by the above recited decretal order directed to be¬
paid and distributed to the said Plainliffs and
the said defendants James Demides and ann his
wite respectively and on receipt of the said sum
of one hundred and sixty nine pounds twelve
shilling and one penny farthing to give full and
sufficient acquitances and discharges for the same
and every part thereof herebi geving and gran
ting unto the said Herman Berens and John Berens
and to either of them full power and authority to
make do and Execute all and every other reasonabe
and lawfull act and acts thing and things in
and about the premisses as she the said Jane
la Hays could or might have lawfully done is
personnally present, In witness whereof the
said Jane la Hays hath hereunto set her hand
and seal in Amsterdam this 13 day of february

a proportionable part of the Costs of all parties and
other deductions as in the said decree is particular

And Whercas the said Charles Tuyler hath in pursu
ance of the abore recited order by his report date dth
seventeenth day of July one thousand seven hundrek
and fifty eight Certifyed to his majestys said
Court of Exequer that he hath sold the long Annuili
Exchequer order and the several government securitys
transferred to him by the said deft. Peter Thomas
the not produce whereof and of the above mentiones
other particulars after the deductions a foresaid
amounts to the clear sum of three thousand thres
hundred and ninety twe pounds two shillings and
twe pence half penney and that u tenth part theres
of amounts to the sum of three hundred and thirt
nine pounds four shillings and two pence halfpenni
as in and by the above receted decretal order and
report relation being thereunto respeclvely had mag¬
and will more fully appear And Whereas the
said Jane la Hays (now residing in the City of
Amsterdam in the province of Holland in parts
beyond the seas) one of the above named Planiliffs
is uinder the will of the said Gideon Lauberaine
intituled to the sum of one hundred and sixty nine
pounds twelve shillings one penny farthing being
a moiety of one tenth of the said sum or three
thousand three hundred and ninety two pounds
